1. Service Overview
Hashe is an end-to-end encrypted messaging application, designed and published by DEVOLIM, a sole proprietorship registered under SIREN 948 000 757, headquartered in France.

2. Acceptance of Terms
By downloading, installing, or using the Hashe application, you unconditionally accept these Terms of Use. If you do not accept these terms, you must not use the application.
DEVOLIM reserves the right to modify these terms at any time. Users will be informed of any substantial modification via the application. Continued use after modification constitutes acceptance of the new terms.
3. Minimum Age
You must be at least 13 years old to use Hashe. If you reside in a European Union country, the minimum age is 16 years, in accordance with the General Data Protection Regulation (GDPR).
By using the application, you declare that you meet the minimum age requirement in your jurisdiction. Since DEVOLIM does not collect any personal data, age verification relies on this declaration.
4. Registration and Account
4.1 No personal data required
Hashe does not require a phone number, email address, or any personal information to create an account. Your identity is limited to an automatically generated anonymous identifier (Hashe ID).
4.2 One device = one account
Each Hashe account is linked to a single device. It is not possible to synchronize an account across multiple devices. Transferring an account to a new device results in the permanent deletion of data from the previous device.
4.3 PIN Security
You are solely responsible for the security of your PIN code. Hashe cannot reset or recover your PIN. Losing your PIN and your recovery phrase results in the permanent loss of access to your account and all your data.
5. Acceptable Use
By using Hashe, you agree not to:
- Use the service to distribute, store, or share child sexual abuse material (CSAM) or child exploitation content;
- Organize, promote, or facilitate terrorist activities or violent extremism;
- Distribute content inciting hatred, discrimination, or violence against any person or group;
- Harass, threaten, or intimidate other users;
- Distribute malware, viruses, or any harmful code;
- Attempt to compromise, bypass, or alter the security mechanisms of the application;
- Impersonate another person or entity;
- Use the service for spam, phishing, or social engineering purposes;
- Violate applicable laws and regulations in your jurisdiction.
5.1 International Sanctions
You declare that you are not subject to international economic sanctions (including those imposed by the European Union, the United States, or the United Nations) and that you do not use Hashe to circumvent such sanctions. DEVOLIM reserves the right to suspend access to the service in regions subject to comprehensive sanctions.
6. Suspension and Deletion
DEVOLIM reserves the right to suspend or delete access to an account in the event of a confirmed violation of these terms, particularly upon receipt of a legitimate abuse report.
Due to Hashe's zero-knowledge architecture, any moderation action is limited to minimal technical metadata (anonymous identifiers) and can in no case apply to message content, which is end-to-end encrypted.
In the event of suspension or deletion, you have a right of appeal by contacting [email protected] within 30 days of being notified of the decision. Your appeal will be reviewed as promptly as possible.
7. Intellectual Property
All elements of the Hashe application, including but not limited to the source code, design, graphics, text, sounds, logos, and the Hashe trademark, are the exclusive property of DEVOLIM or are subject to specific licenses (including open source components).
Any unauthorized reproduction, distribution, modification, or use of these elements is strictly prohibited except within the framework of applicable open source licenses.
8. User Content
All messages, files, notes, and media exchanged via Hashe are end-to-end encrypted. DEVOLIM has no technical ability to access the content of your communications.
You are solely responsible for the content you create, send, or share via the application. You warrant that this content complies with applicable laws and these terms.
9. Limitation of Liability
9.1 No Warranty
Hashe is provided "as is" and "as available," without any express or implied warranty, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
9.2 Exclusions
DEVOLIM shall not be held liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the service, including data loss, loss of profits, or business interruption.
9.3 Liability Cap
Since Hashe is an entirely free service, with no advertising and no in-app purchases, DEVOLIM's total liability to you is capped at 0 EUR (zero euros).
9.4 User Responsibility
You are solely responsible for safeguarding your credentials (PIN, recovery phrase). DEVOLIM shall in no case be held liable for the loss of access to your account due to the loss of this information.
9.5 Third-Party Services
Hashe may rely on third-party services (hosting, push notifications). DEVOLIM shall not be held liable for failures, interruptions, or modifications of these third-party services.
10. Availability and Force Majeure
DEVOLIM endeavors to maintain the service accessible 24 hours a day, 7 days a week. However, the service may be temporarily interrupted for maintenance, updates, or any other technical reason.
DEVOLIM shall not be held liable for any service interruption resulting from a force majeure event, as defined by French law, including but not limited to natural disasters, network outages, cyberattacks, government decisions, or any other unforeseeable and irresistible event.
11. Free of Charge
Hashe is an entirely free service. The application contains no advertising, no in-app purchases, and no subscription model. The service is funded exclusively by voluntary user donations and DEVOLIM's own resources.
12. Reporting
12.1 Zero tolerance for CSAM
DEVOLIM enforces a zero tolerance policy toward child sexual exploitation content (CSAM). Although end-to-end encryption prevents DEVOLIM from accessing message content, any report received will be handled with the utmost diligence and forwarded to the competent authorities in accordance with applicable law.
12.2 DSA Point of Contact

13. Governing Law
These Terms of Use are governed by French law. In the event of a dispute relating to the interpretation or performance of these terms, and in the absence of an amicable resolution, the competent courts of Bordeaux (France) shall have exclusive jurisdiction.
14. Severability
If any provision of these terms is declared null or unenforceable by a competent court, the remaining provisions shall remain in full force and effect. The invalidated provision shall be replaced by a valid provision that most closely reflects the original intent.
